86 <br /> <br />A RESOLUTION EXTENDING THE CITY MANAGER'S AUTHORIZATION TO <br />SELL SURPLUS WATER TO SUFFOLK UNDER CERTAIN TERMS AND CON- <br />DITIONS. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia, <br />adopted a Resolution at a meeting held September 23, 1980, <br />authorizing the City Manager to purchase surplus water from <br />the City of Suffolk during a draught-caused emergency and <br />to sell water to Suffolk under similar conditions; and <br /> <br /> WHEREAS, the Council of the City of Suffolk adOpted a <br />Resolution at a meeting held September 17, 1980, authorizing <br />their City Manager to sell surplus water to the City of <br />Portsmouth utilizing a formula acceptable to Portsmouth so <br />long as the formula is reciprocal in the event that the <br />City of Suffolk shall have a need to purchase water in the <br />future from Portsmouth reserves; and <br /> <br /> WHEREAS, the City of Suffolk has indicated a desire to <br />purchase surplus water from the City of Portsmouth pending <br />the completion of Suffolk's Treatment Plant if the same is <br />under construction at the time Suffolk acquires the distri- <br />bution system from Portsmouth now under litigation; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth concludes <br />that such additional terms and conditions to such proposed <br />sale and purchase is mutually beneficial to both cities. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth that the City Council does hereby extend <br />the authorization of the City Manager to enter into an agree- <br />ment with the City of Suffolk to permit the sale of surplus <br />water to the City of Suffolk pending the completion of Suffolk's <br />Treatment Plant if the same is under construction at the time <br />Suffolk acquires the distribution system from Portsmouth now <br />under litigation- <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he <br />hereby is, authorized to execute such agreements and other <br />documents as may be necessary to complete this transaction. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held October 14, 1980. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
