A RESOLUTION RELEASING A PORTION OF AN EASEMENT ON THE PROPERTY OF WILLIAM A. HO?~LL; AUTHORIZING THE CITY MANAGER TO EXECUTE A RELEASE DEED. 6O WHERF~S, by an easement agreement recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth in Deed Book 695, page 685, William A. Howell conveyed to the City of Portsmouth a utility easement for the ~urpose of installation of storm drainage in connection with the Paradise Creek drainage improvements; and WHE~REAS, the installation of said drainage improvements has been completed and a portion of the easement created by said agreement is no longer required by the City of Portsmouth; and WHEREAS, the City Engineer has recommended that the hereinafter-described portion of said drainage easement be released. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the following described portion of the drainage easement created by easement agreement recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth in Deed Book 695, page 685, be released to William A. Howellr to-wit: All that certain piece or parcel of land shown on that certain plat en- titled, "Plat Showing A Portion Of Sanitary Sewer Easement To Be Vacated By The City Of Portsmouth On The Pro- perty of William A. Howell", dated August 5, 1980, prepared by the Engineering & Technical Services Department of the City of Portsmouth, Virginia, a copy of which is attached hereto for a more par- ticular description. BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to execute such deeds of release as may be necessary to complete this transaction provided that a pro rata of any consideration oaid be reimbursed to the City.
