52 <br /> <br />A RESOLUTION AUTHORIZING THECONSTRUCTION AND INSTALLATION <br />OF SIDEWALKS ALONG MEDIAN CIRCLE FROM GREENWOOD DRIVE TO <br />STRATFORD STREET ABUTTING 201 THROUGH 231 ~DIAN CIRCLE <br />(BOTH INCLUSIVE) AND 3805 GREENWOOD DRIVE WHERE STANDARD <br />SIDEWALKS DO NOT NOW EXIST, ASSESSING THE ABUTTING OWI~ERS <br />AT THE COST OF $3.00 PER FRONT LINEAL FOOT AND DIRECTING <br />THAT AN ABSTRACT OF THIS RESOLUTION BE RECORDED TOGETHER <br />WITH A STATEMENT SHOWING THE ESTIM~TEDAMOUNT THAT WILL <br />BE ASSESSED AGAINST EACH SUCH LANDOWNER. <br /> <br /> WHEREAS, by petition submitted in accordance with <br />law, certain abutting landowners have petitioned the City <br />of Portsmouth to construct the sidewalk along Median Circle <br />from Greenwood Drive to Stratford Street abutting 201 through <br />231 Median Circle (both inclusive) and 3805 Greenwood Drive <br />where standard sidewalks do not now exist, the cost thereof <br />to be apportioned between the City and the abutting land- <br />owners; and <br /> <br /> WHEREAS, notice has been duly given to the abutting <br />landowners, as provided by law, that a hearing would be held <br />before the Council of the City of Portsmouth, Virginia, on <br />June 24, 1980, at 7:30 P. M. in the Council Chamber; and <br /> <br /> WHEREAS, the said hearing was duly held and in the <br />judgment of the Council, the said sidewalk should be con- <br />structed. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1. That the construction of a sidewalk along Median <br />Circle from Greenwood Drive to Stratford Street abutting <br />201 through 231 Median Circle ~both inclusive) and 3805 <br />Greenwood Drive, where standard sidewalks do not now exist, <br />is hereby authorized. <br /> <br /> 2. That the abutting landowners shall be assessed at <br />the rate of Three Dollars ($3.00) per front lineal foot pur- <br />suant to a petition signed by seventy-five percent ~5%) of <br />the property owners affected by tt~e requested improvements. <br /> <br /> 3. That the City Clerk shall forthwith cause an abstract <br />of this resolution to be recorded in the Clerk's Office of <br />the Circuit Court of the City of Portsmouth, together with a <br />statement showing the ownership and location of the property <br />to be affected by the proposed construction of the sidewalk <br />and the estimated amount that will be assessed against each <br />abutting landownerin-accordance with the statement thereof <br />on file in her office. <br /> <br /> <br />
