9 A RESOLUTION GRANTING A USE PERMIT TO LEE HOWARD PARTNERSHIP TO OPERATE MINI SELF-STORAGE WAREHOUSES ON LAND LOCATED AT THE NORTHEAST CORNER OF YORKSHIRE ROAD .~ND AIRLINE BOULEVARD. WHEREAS, Lee Howard Partnership, by Irvin Caplan~ Partner, has made an application pursuant to §40-71(b), Code of the City of Portsmouth, 1970, as amended, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and'the Planning Director have done all things required to be done in connection with said appli- cation; and ~%~r~EREAS, the Planning Commission has recommended the grant- ing of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter- described is sought: (a) will not adversely affect the health and safety of persons residing and working in the neighborhood of the pro- posed use; (b) Will not be detrimental to the public use or injurious Go the property or improvements ~ the neighborhood; and (c) will be in accord with the purposes of the ~ Zoning Chapter of the City Code. 2. That Lee Howard Partnership is hereby granted a use permit pursuant to ~40-71(b), Code of the City of Portsmouth, 1973, as amended, to operate mini self-storage warehouses on property described herein subject to the conditions set forth in Paragraph 3. UP-80-t4 Beginning at the northeast corner of Yorkshire Road and Airline Boulevard; thence easterly along the north right-ofJway of Airline Boulevard 770', more or less; thence northerly 312.38'; thence westerly 638.15'; thence northerly 144.02'; thence westerly 216.50'; thence southerly 115'; thence southwesterly 60' to the east right-of-way of Yorkshire Road; thence southerly 355', more or less, to Airline Boulevard, the point of origin.
