21 A RESOLUTION AUTHORIZING THE. CITY MANAGER TO MAKE ABBLICATiON TO THE SECRETARY OF INTERIOR TO SECURE THE TRANSFER OF A PORTION OF ST. JULIEN'S CREEK ANNEXOF NORFOLK NAVAL SHIPYARD FOR USE AS A PUBLIC PARK AND RECREATIONAL AREA. WHEREAS, the City of Portsmouth has made use of a certain portion of the St. Julien's Creek Annex, Norfolk Naval Shipyard, comprising approximately 42~8 acres, for recreational purposes pursuant to a lease agreement with the United States Navy; and ........... ..... WHEREAS, the Unzted Sta~--l~avy h~s---d&cl~fed s~id ................ property to be surplus property and has assigned the same to the general services administration for the-purposes of disposal pursuant to Federal law and regulations~ and WHEREAS, the Council of the City of Portsmouth deems it to be in the best interest of the citizens of-the City of Portsmouth and the surrounding cities that said property continue to be used for recreational purposes;-and WHEREAS, said property may be assigned to the Secretary of the Interior for disposal for public park or recreational purposes under the provisions of Section.203(k)'(2) of the Federal Property and Administrative Services Act of 1949, as amended~ and the rules and regulations pursuant thereto; and WHEREAS, said property is more particularly described as a 42.8 acre portion of St. Julien's Creek Annex of the Norfolk Naval Shipyard, and the improvements thereon, located in the City of Chesapeake, Virginia, on Victory' Boulevard, GSA Control No. N-VA-5?9(C); and WHEREAS, the City of Portsmouth needs and will utilize said property in perpetuity for a public park or recreation area as set forth in its application and in accordance with the requirements of said Act and the rules and regulations promulgated thereunder. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, VirgInia, that ~he City'Manager be, and he hereby is, authorized to make application to the Secretary of the Interior for and secure the transfer to it of the above-mentioned property for said use upon and subject to such exceptions, reservations, terms, covenants, agreements, conditions and restrictions as the Secretary-of the Interior or his authorized representative may require in connection with the disposal of said property under said Act and the rules and regulations issued pursuant thereto.
