21 <br /> <br />A RESOLUTION AUTHORIZING THE. CITY MANAGER TO MAKE ABBLICATiON <br />TO THE SECRETARY OF INTERIOR TO SECURE THE TRANSFER OF A <br />PORTION OF ST. JULIEN'S CREEK ANNEXOF NORFOLK NAVAL SHIPYARD <br />FOR USE AS A PUBLIC PARK AND RECREATIONAL AREA. <br /> <br /> WHEREAS, the City of Portsmouth has made use of a <br />certain portion of the St. Julien's Creek Annex, Norfolk <br />Naval Shipyard, comprising approximately 42~8 acres, for <br />recreational purposes pursuant to a lease agreement with the <br />United States Navy; and <br /> <br />........... ..... WHEREAS, the Unzted Sta~--l~avy h~s---d&cl~fed s~id ................ <br /> property to be surplus property and has assigned the same to <br /> the general services administration for the-purposes of <br /> disposal pursuant to Federal law and regulations~ and <br /> <br /> WHEREAS, the Council of the City of Portsmouth deems it <br />to be in the best interest of the citizens of-the City of <br />Portsmouth and the surrounding cities that said property <br />continue to be used for recreational purposes;-and <br /> <br /> WHEREAS, said property may be assigned to the Secretary <br />of the Interior for disposal for public park or recreational <br />purposes under the provisions of Section.203(k)'(2) of the <br />Federal Property and Administrative Services Act of 1949, as <br />amended~ and the rules and regulations pursuant thereto; and <br /> <br /> WHEREAS, said property is more particularly described <br />as a 42.8 acre portion of St. Julien's Creek Annex of the <br />Norfolk Naval Shipyard, and the improvements thereon, located <br />in the City of Chesapeake, Virginia, on Victory' Boulevard, <br />GSA Control No. N-VA-5?9(C); and <br /> <br /> WHEREAS, the City of Portsmouth needs and will utilize <br />said property in perpetuity for a public park or recreation <br />area as set forth in its application and in accordance with <br />the requirements of said Act and the rules and regulations <br />promulgated thereunder. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, VirgInia, that ~he City'Manager be, and <br />he hereby is, authorized to make application to the Secretary <br />of the Interior for and secure the transfer to it of the <br />above-mentioned property for said use upon and subject to <br />such exceptions, reservations, terms, covenants, agreements, <br />conditions and restrictions as the Secretary-of the Interior <br />or his authorized representative may require in connection <br />with the disposal of said property under said Act and the <br />rules and regulations issued pursuant thereto. <br /> <br /> <br />
