10 <br /> <br />A RESOLUTION APPOINTING VIEWERS FOR THE CLOSING OF A TWENTY <br />'FOOT ALLEY BETWEEN BROADWAY STREET AND ADAMS STREET. <br /> <br /> WHEREAS, John A. Bender, by his attorney, George Talbot, <br />has made application to vacate, close and discontinue the <br />hereinafter described portion of a twenty foot alley, and it <br />appearing that notice of application in request for %he appointment <br />of viewers was duly posted on January !!, 1982, in the Circuit <br />Court of the City of Portsmouth, the General District Court of <br />the City of Portsmouth (Civil Division) and in the City Hall <br />Building of the City of Portsmouth. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that A.N. Kendrick, Charles R. Hudgins, <br />Robert Reed, Harrison Miller and R. Irvine Smith be appointed <br />viewers and that Clinton J. Fortune and Raymond Tweed be <br />appointed alternate viewers in the event one of the preceding <br />viewers fails to participate, said vie%~ers to view the herin- <br />after described portion of such street ~nd to report to this <br />Council in writing whether in their opinion, any, and if any <br />what, inconvenience would result in vacating and closing the <br />following: <br /> <br /> A twenty (20') foot portion or strip of <br />an alley which is located on the Eastern side <br />of Mariner Avenue, "formerly Fourth Avenue" <br />and running back between parallel lines~ said <br />lines being the boundaries of Lot 309 and Lot <br />311 Mariner Avenue, one hundred feet in a <br />Northeasterly direction to a point, said <br />twenty (20') foot alley being contiguous to <br />the property of John A. Bender, Inc., a <br />Virginia corporation.
