65 A RESOLUTION GRANTING A USE P~-P~IT TO FARM FRESH SUPEt~LARKETS, INC. TO OPEP~ATE A FARM FRESH SUPERMARKET AT 1701 HIGH STREET. ~EREAS, Cynthia L. Smith, A~sistant Real Estate Manager for Farm Fresh Supez?~.arketst ~nc.~ made an application pursuant to §40-68.! (e) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter-described; and . t~e applicant and %he Planning Director have done all things ~eq~ed to be done mn connection with said appli- cation; and W.,EREAm, the Plannln~ Co~,~..zsslon has recommended the granting of sa].,.~ use permit. NOW, THEREFORE, BE ~T RESOLVED by the Council of the City of Portsmouth, Virginia: i. That the use for which the use permit hereinafter- described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the pro- posed use; zn] urzous and (b) Will not be detrimental to the public use or 2o the property or improvements in the neighborhood; ¢c~ Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Farm Fresh Supermarkets, Inc. is hereby granted a use permit pursuant to §40-68.1 (e) of the Code of the City of Portsmouth, Virginia to operate a Farm Fresh Supermarket on the property designated as 1701 High Street and more particularly described as Tax Plate 113, Parcel 8. 3.- The following conditions are prescribed for this use peter, it: [a) Farm Fresh Supermarkets, Inc. shall comply with all statutes~ ordinances, policies and regulations of the federal, state and local goverm_ments that may be applicable to the proposed use and shall have obtained all necessary licenses and permits required for this use.
