A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE EASEMENTS FOR PUBLIC UTILITIES IN THE PORTION OF EIGHTH STREET AND GARFIELD STREET. WHEREAS, by Ordinance adopted by the Council of the City of Portsmouth, Virginia on DeceMber 12, 1978, recorded in Deed Book 746, page 334 in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, a portion of Eighth Street between Fayette Street and Madison Street was closed as a public street; and WHEREAS, by Ordinance adopted by the Council of the City of Portsmouth, Virginia on November 25, 1980, recorded in Deed Book 798, page 311 in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, a portion of Garfield Street between Nineth Street and G~een Street was closed as a public street; and WHEREAS, pursuant to the terms of said ordinances the City of Portsmouth reserved an easement for the purpose of installation, maintenance, operation of sewer mains, sewer drains-, sanitary sewers, storm drains, water mains and laterals and electric power lines within, over, under and across said portions of th~ streets; and WHEREAS, Portsmouth Redevelopment and Housing Authority has requested that said easements be released; and W~EREAS, said utilities have been City no longer requires access to said purpose of operating said utilities. relocated and the streets fer the NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, V-irginia, that the City Manager be, and he hereby is, authorized to execute a deed of release for the utility easements retained in that portion of Eighth Street which was'closed by Ordinance of this Council adopted December 12, 1978 and that portion of Garfield Street which was closed by Ordinance adopted by this Council on November 25, 1980.
