128 <br /> <br />A RESOLUTION AUTHORIZING THE CITY ~LANAGER TO CONVEY A SANITARS[ <br />SEWER EASEMENT TO THE CITY OF SUFFOLK. <br /> <br /> WHEREAS, the City of Portsmouth owns certain real property <br />located in the City of Suffolk; and ~. <br /> WHF/AEAS, the City of'Suffolk has requested that an ease- <br />ment be granted for the prupose of constructing a sanitary <br />sewer utility line across said property as hereinafter-described; <br />and <br /> <br /> WHEREAS, the construction of said sanitarv-.~sewer line <br />by the C!ty of ~ff0tk will be of benefit to the City of <br />Portsmouth by eliminating potential polution problems for the <br />Lake Meade rese~../oir from. pr!va~e residential septic tanks; and <br /> <br /> WEE~AS, ~2.09 (c} of the Charter of the City of Portsmouth <br />provides that the City may convey an interest in real property <br />to the Co~onwea!th of Virginia or a political subdivision <br />thereof without advertisement and receipt of bids; and <br /> <br /> WHEREAS. the City of Suffolk is a political subdivision <br />of the Co~on~eatth of Virginia. <br /> <br /> NOW, T~EFtEFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia that the City Manager be, and he hereby <br />is, authorized to convey to the City of Suffolk an easement for <br />the purposes cf installing, operating and ~intaining a sanitary <br />sewer utility line over, under and across the following describeO <br />property, <br /> <br /> Ail ~Jaat certain piece or parcel of land sit- <br />uate on the south side of Garfield Avenue, Route <br />1402, designated as Lot 12 on the 'subdivision of <br />"Boston Park Subdivision", recorded in the Clerk's <br />Office of the Circuit Court of the City of Suffolk, <br />Virginia, inDeed Book 214, pages 464 through 468, <br />both inclusive. <br /> <br /> Said easement being more particularly described <br />by reference to that certain plat entitled "20' <br />Utility Easement, Lot 12, Property Of The City Of <br />Portsmouth, Virginia", dated July 1983, a copy of <br />which is attached hereto. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he <br />hereby is, authozized to execute such agreements and documents <br />as may be necessary to complete this transaction. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held December 13, 1983. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
