126 A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION'40-55 OF THE CODE OF THE CITY OF PORTS- MOUTH, VIRGINIa, 1973, AS AMENDED, SAID PROJECT BEING KNOWN AS WATERS EDGE AND DESIGNATED GHP-83-6. W~EREAS, p. H. Boyette, Jr. and Company, Inc., has made application pursuant to ~40-55 of the Co~ of the City of Portsmouth, Virginia, 1973, as amended, for {he granting and approval of a group housing project known as Waters Edge Condominiums; and WHEREAS, the application has been deterrained by the Planning Con~r~ission to have met the requirements of ~40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amended; and <~ WPiERF~AS~ the Planning Connuission has reviewed such application and sl~e plans submitted therewith, and has recommended a conditional approval of said application; and W~2~R~A~ the developer has been informed that approval of a group housing project pursuant '%o N40-55 grants only an xempt_~n ...... certain requ!rements for residences as stated in said section and does not constitute a waiver of any other requireme-~te~bodied in the Subdivision Ordinance, Zoning Ordinance, the Code of the City of Portsmouth, Virginia, or any other applicable local, state or federal laws or regulations; and kE~EREAS, the developer is aware that'building perm±ts or any other required permit will be issued only upon compliance with the omdinances, laws or regulations applicable thereto. NOW, T~REFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the certain group housing project kno~.~ as Waters Edge Condominiums and designated as GHP-83-6, more specifically shown on plans prepared by The Yates Group, dated October 10, 1983, and filed with the appro- priate officials of the City of Portsmouth, Virginia, and made a part hereof, is hereby granted approval subject to the following terms and conditions: (i) Detailedengtneerzng· ~ drawings' and utility system layouts mustsatisfy' the Fire Department and the Public Works Department. (2) A detailed landscaping'plan must be submitted to the Planning Department for their review and approval. Such landscaping should provide some vegetational screening along the entry roadway and parking lot.
