10.5 A RESOLUTION DESIGNATING CERTAIN RAILROAD CROSSINGS AS BEING POORLY MAINTAINED BY THE SEABOARD COAST LINE RAILROAD COMPANY; AUTHORIZING THE CITY MANAGER TO NOTIFY SEABOARD COAST LINE RAILROAD~COMPANY PURSUANT. TO SECTION 56-405, CODE OF VIRGINIA, AND TO TAKE SUCH FURTHER ACTION AS MAY BE NECESSARY TO REPAIR THE SAME-. WHEREAS,' the Seaboard Coast Line Railroad Company operates certain hereinafter-described railroad crossings over public streets in the City of Portsmouth; and % WHEREAS, said railroad company is required by-law to keep such crossings in good repair to the full width of the public street and to maintain such crossings in a smoothe condition so as to admit reasonable and safe travel over the same; and WHEREAS, the hereinafter-descriBed crossings have not been ~Laintained in such good repair and condition. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the following described railroad crossings are designated as being poorly maintained by Seaboard Coast Line Railroad Company. (i) Frederick Boulevard between Incinerator Road and Project Drive; (2) Victory Boulevard between Airline Boulevard and Alexander Street; (3) 1-264; Portsmouth Boulevard between Turnpike Road and (4) Elm Avenue between South Street and Race street; (5) Churchland Boulevard between High Street West and Tyre Neck Road. BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to notify Seaboard Coast Line Railroad Company of the condition of said crossings pursuant to ~56-405, Code of Virginia, and to take such further action pursuant to said section of the Code of Virginia as may be necessary to repair the same.
