10.5 <br /> <br />A RESOLUTION DESIGNATING CERTAIN RAILROAD CROSSINGS AS BEING <br />POORLY MAINTAINED BY THE SEABOARD COAST LINE RAILROAD COMPANY; <br />AUTHORIZING THE CITY MANAGER TO NOTIFY SEABOARD COAST LINE <br />RAILROAD~COMPANY PURSUANT. TO SECTION 56-405, CODE OF VIRGINIA, <br />AND TO TAKE SUCH FURTHER ACTION AS MAY BE NECESSARY TO REPAIR <br />THE SAME-. <br /> <br /> WHEREAS,' the Seaboard Coast Line Railroad Company operates <br />certain hereinafter-described railroad crossings over public <br />streets in the City of Portsmouth; and % <br /> <br /> WHEREAS, said railroad company is required by-law to <br />keep such crossings in good repair to the full width of the <br />public street and to maintain such crossings in a smoothe <br />condition so as to admit reasonable and safe travel over <br />the same; and <br /> <br /> WHEREAS, the hereinafter-descriBed crossings have not <br />been ~Laintained in such good repair and condition. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia, that the following described <br />railroad crossings are designated as being poorly maintained <br />by Seaboard Coast Line Railroad Company. <br /> <br /> (i) Frederick Boulevard between Incinerator Road and <br />Project Drive; <br /> <br /> (2) Victory Boulevard between Airline Boulevard and <br />Alexander Street; <br /> <br /> (3) <br />1-264; <br /> <br />Portsmouth Boulevard between Turnpike Road and <br /> <br />(4) Elm Avenue between South Street and Race street; <br /> <br /> (5) Churchland Boulevard between High Street West and <br />Tyre Neck Road. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he <br />hereby is, authorized to notify Seaboard Coast Line Railroad <br />Company of the condition of said crossings pursuant to ~56-405, <br />Code of Virginia, and to take such further action pursuant to <br />said section of the Code of Virginia as may be necessary to <br />repair the same. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held November 8, 1983. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
