93 A RESOLUTION GRANTING A USE PE~4IT TO REVEREND LEROY DANIELS, JR., FOR A CHURCH AND HOUSE OF WORSHIP AT 610 GREEN STREET. WHEREAS, Reverend Leroy Daniels, Jr., contract lessee for Dr. Hugo A. Owens, owner, has made application pursuant to ~40-72 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said appli- cation; and WHEREAS, the Planning Commission has recommended the granting of said use pez/uit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter- described is sought: (a) Will not as a temporary use for a period not to exceed eighteen (18) months adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not as a temporary use for a period not to exceed eighteen (18) months be detrimental to the public use or injurious to the property or improvements of the neighborhood; and (c) Will as a temporary use for a period not to exceed eighteen (18) months be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Reverend Leroy Daniels, Jr. is hereby granted a use permit pursuant to §40-72 (b) of the Code of the City of Ports- mouth, Virginia to operate a church and place of worship to be kno%~ as Gilead Baptist Church at 610 Green Street, being more particularly described as Tax Map 25, Parcel 32 (UP-83-5). 3. This use permit is approved subject to the following conditions: (a) The applicant will comply with all codes, ordinances and regulations of Commercial C-3 Zoning District requirements relating to the operation of churches and houses of worship.
