92 A RESOLUTION GRANTING A USE PERMIT TO ROSSO AND ~STRACCO, INC. TO OPERATE A TINEE GIANT CONVENIENCE STORE AND GASOLINE ISLAND AT 4716-18 PORTSMOUTH BOULEVARD. WHEREAS, C. Richard Griffith, Agent, Ednina Realty Corp- oration for Rosso and Mastracco, Inc. has made application pursuant %o ~40-70(b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter- described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said appli- cation; and WHEREAS, the Planning Commission has recommended the grant- ing of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter- described is sought: (.a) Will of persons residing posed use; (b) Will injurious and not adversely affect the health and safety or working in the neighborhood of the pro- not be detrimental to the public use or to the property or improvements of the neighborhood; (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Rosso and Mastracco, Inc. is hereby granted a use permit pursuant to ~40-70(b~ of the Code of the City of Portsmouth, Virginia, to operate a convenience store and gasoline island at 4716-18 Portsmouth Boulevard, such property being more particularly described as Tax Plate 435, Parcel 21~ such site consisting of 11,326 square feet (UP-83-i2). 3. This use permit is approved subject to the following conditions: (a) screening as required by §40-44 of the City Code must be provided. The screening plan must be submitted to the Planning Office of the City of Portsmouth for approval prior to the issuance of a building permit. (b) Du3npster location and screening must be approved by the Department of Public Works prior to installation approval.
