79 A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY O~ED BY ELBERT DAVIS ~N~ BARBARA D. DAVIS, UNDER EMINENT DO~A!N PROCEEDINGS PD~SUAN~ TO THE CHARTER OF THE CITY OF PORTSMOUTH~ AS A~!EA~ED~ SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCT!ONj ALTERATION .~D WIDENING OF WEST NORFOLK ROAD. ?~q~ER~S~ the Council of the City of Portsmouth has determined it to be in the public interest to reconstruct, alter and wi~en West Norfolk Road~ and WHEREAS, the City has ~ound it necessary to acquire the fee simple interest in and to the hereinafter-described parcel of land situated in the City of Portsmouth, Virginia, for the said purpose of reconstructing, altering and widening West Norfolk Road; and WHEREAS~ th~ City has not been able to purchase the property described herein, necessary to the project, because the owners thereof and the City have ~ot been able to agree upon the price to be paid therefor; and WHEREAS, advancement of will be unreasonably delayed able for the project as soon the work and use of said property if said property is not made avail- as possible. NOW, TF~REFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: That the City Attorney be, and he hereb~ is, directed to institute eminent domain proceedings against the hereinafter- described property situated in the City of Portsmouth, Virginia, for the purpose of acquiring fee simple title therein, together with any and all easements of access, light or air incident to the lands of the landowner abutting upon said property, in accordance with, and pursuant to, ~2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth, Virginia, as a/aended, and to deposit to the credit of the Clerk of the Circuit Court of the City of Portsmouth as provided by law the sum hereinafter specified to compensate the owners of the property designated as Parcel 056 on that certain plat entitled "Plat Showing Pro- posed R~ght-of-Way Expansion For Wes~ Norfolk Road", dated July !i~ !983~ prepared by the Engineering & Technical Services Department of the City of Portsmouth, virginia, recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, in Map Book 12, pages 68 through 71, both inclusive. The name of the property owners are: Barbara D. Davis. Elbert Davis and The amount to be deposited to the credit of the Clerk of the Circuit Court of the City of Portsmouth is: $1,300.00.
