A RESO~JTiON G~ANTING A USE PE~IT TO LA PETITE ACADEMY, INC. TO CONSTRUCT AND OPERATE A CHILD DAYCARE CENTER AT 5851 TRUCKER STREET. %~n~AS, Monogra~ Real Estate Counselors, 'Inc. by Rober~ G. Rogers, on behalf of La Petite Academy, !nc., has made application pursuant to Section 40-79(b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the Planning Director have done ali things required to be done in connection with said application; and ~riEREAS, the Planning Commission has recommended the granting of said use permit. NOW~ THEREFORE~ BE IT RESOLVED by the Council of the City of Portsmouth~ Virginia: That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; injurious and (b) Will not be detrimental to to the property or improvements the oublic use or in the neighborhoo~ (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. La Petite Academy~ Inc., is hereby granted a use permit pursuant to Section 40-79[b) of the City Code to operate a child daycare center at the property described as follows: UP82-20 Beginning at the southwest intersection of Trucker Street and property of the Seaboard Coast Line Railroad Company; thence west along the soubhern boundary of Trucker Street 215 feet to a point; thence south and ~aral!el with the property of Seaboard Coast Line Railroad i43 feet to a point; thence east and parallel with Trucker Street 215 feet to a point on the boundary of the Seaboard Coast Line Railroad property; thence north along the boundary of Seaboard Coast Line Railroad property 143 feet to the point of beginning.
