31 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTS- <br />MOUTH, VIRGINIA, 1973, AS AM_ENDED, SAID PROJECT BEING A <br />SIX-UNIT APARTMENT BUILDING LOCATED ON THE ~WEST SIDE OF HAMILTON <br />AVENUE, SOUTH OF COMMERCE STREET AND DESIGNATED AS GHP-85-4. <br /> <br /> WHEREAS, Raymond Hembree and Ernest Consolvo have made <br />application pursuant to ~40-55 of the Code of the City of <br />Portsmouth, Virginia, 1973, as amended, for the granting and <br />approval of a group housing project consisting of a six-unit <br />apartment building to be constructed on the west side of <br />Hamilton Avenue, south of Commerce Street; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of Section <br />40-55 of the Code of the City of Portsmouth, Virginia, 1973, <br />as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such appli- <br />cation and site plans submitted therewith and has recommended <br />approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of <br />the housing project pursuant to said Section 40-55 grants only <br />an exemption from certain requirements for residences as stated <br />in said section and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning Ordi- <br />nance, Code of the City of Portsmouth, Virginia, or any other <br />applicable local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developers are aware that building permits <br />or any other required permit will be issued only upon compli- <br />ance with the ordinances, laws, or regulations applicable there- <br />to. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the certain group housing project <br />consisting of a six-unit apartment building to be constructed on <br />the west side of Hamilton Avenue, south of Commerce Street, which <br />has been designated as GHP-85-4 and more specifically described <br />in correspondence from Raymond Hembree, dated February 4, 1985, <br />and February 25, 1985 as shown on plans filed with the appro- <br />priate officials of the City of Portsmouth, Virginia, such being <br />made a part hereof, is hereby granted approval subject to the <br />following terms and conditions: <br /> <br /> 1. Vinyl shutters shall be used on all windows viewed <br />from Hamilton Avenue; <br /> <br /> 2. A landscape plan showing treatment of the dumpster <br />screening and shifting the building south to preserve existing <br />vegetation must be submitted to the Planning Office for review <br />and approval prior to the issuance of building permits; and <br /> <br /> <br />
