120 A RESOLUTION GRANTING A USE PERMIT TO A. LOUISE HILL TO OPERATE A CHILD CARE CENTER AT 2708 BAGLE¥ STREET. WHEREAS, Philqrador D. Duke, by A. Louise Hill, Administrator, has made application pursuant to ~40-75 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit to operate a child care center; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of a use permit for the operation of a child care center. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: sought: That the use for which the use permit is safety of neighborhood of (a) will not adversely affect the health persons residing or working in the the proposed use; and (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. A. Louise Hill is hereby granted a use permit pursuant to ~40-75 (b) of the City Code to operate a child care center at the property described as Tax Plate 205, Parcel 62, and designated as 2708 Bagtey Street (UP-85-25). 3. This use permit is approved subject to the following conditions: (a) All interior operations of this facility must be conducted between the hours of 6:00 a. m. and 6:00 p. m.. (b) All outdoor play activities shall be conducted within a fenced play a~ea and limited to the hours of 8:00 a. m. ~o 6:00 p. m.. The fencing shall completely enclose the play area and be properly maintained.
