116 <br /> <br />A RESOLUTION AUTHORIZING THE CITY ~ANAGER TO SIGN A DEED OF <br />RELEASE FOR A PORTION OF A PUBLIC UTILITY EASemENT ON PROPERTY <br />FORMERLY DESIGNATED GIBBS ROAD. <br /> <br /> WHEREAS, by resolution adopted by the Council of thee City <br />of Portsmouth on FeD~uary 13, 1979 that portio~ of Gibbs Road <br />between Victory Boulevard and Dahlgren Avenue was closed and <br />vacated as a public right-of-way; and <br /> <br /> WHEREAS, <br />Portsmouth an <br />operating and <br />within the 40' <br /> <br />said ordinance reserved to the City of <br />easement for the purpose of installing, <br />maintaining Public Utility pipes and lines <br />width of said street; and <br /> <br /> WHEREAS, the developer of adjacent property has requested <br />a release of a portion of said easement in connection with the <br />construction of the multifamily ~esidential development to be <br />known as Cradock Colonials; and <br /> <br /> WHEREAS, <br />that only 20' <br />operation of <br /> <br />the Director of Public Utilities has certified <br />of the 40' easement will be necessary for <br />the existing facilities; and <br /> <br /> WHEREAS, it is the responsibility of the developer to <br />provide additional utilities in connection with the approved <br />development plan. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and ~ <br />hereby is, authorized to sign a Deed of Release for that 20' <br />portion of the easement on property formerly designated Gibbs <br />Road between Victory Boulevard and Dahlgren Avenue, said 20' <br />no longer being necessary for Public Utility facilities. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held October 8, 1985. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
