114 A RESOLUTION GRANTING A USE PERMIT TO JOHNNY OWENS AND RICHARD D. KNAUFT FOR THE CONVERSION OF AN EXISTING SINGLE-F~ILY DWELLING TO A DUPLEX AT 434 CHAUTAUQUA AVENUE (UP-85-22). WHEREAS, Johnny Owens and Richard D. Knauft has made application pursuant to ~40-102 (B) for a use permit to convert an existing single-family residence to a duplex residence at 434 Chautauqua Avenue which is located in the Port Norfolk Historic District; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of a use permit with conditions for the conversion of an existing single-family dwelling to a duplex residential structure. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health safety of persons residing in the neighborhood of the proposed use; and (b) Will not be detrimental to the public or injurious to the property or improvemenns in the neighborhood; and use (c) Will be in-accordance with the purposes of the Zoning Chapter of the City Code. 2. Johnny Owens and Richard D. Knauft are hereby granted a use permit pursuant to §40-102 (B) to convert an existing single-family residence to a duplex residential structure at 434 Chautauqua Avenue, such conversion to be in compliance with the regulations applicable to the Port Norfolk Historic Residential SubdistFict as provided for in the Zoning Chapter of the Code of the City of Portsmouth, Virginia, 1973, as amended, such approval being granted subject to the following term and condition: (a) The applicant shall comply with all applicable codes, ordinance, policies and regulations of the City of Portsmouth, Virginia, and shall obtain all necessary permits and licenses. This ~esolution shall take effect immediately upon its adoption.
