96 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN <br />AGREEMENT WITH HAMPTON ROADS SANITATION DISTRICT FOR THE SALE <br />OF CERTAIN CITY SANITARY SEWAGE FACILITIES; AUTHORIZING THE <br />INSTITUTION OF CERTAIN LEGAL PROCEEDINGS NECESSARY TO <br />INCORPORATE A PORTION OF THE CITY INTO H~4PTON ROADS <br />SANITATION DISTRICT. <br /> <br /> WHEREAS, the City and Hampton Roads Sanitation District <br />have negotiated an agreement for the sale of certain sanitary <br />sewage facilities to Hampton Roads Sanitation District; <br />namely the Pinners Point Sewage Treatment Plant, the Camden <br />Avenue Pump Station, the Rodman Avenue Pump Station, the <br />Elmhurst Lane Pump Station, and certain sanitary sewage force <br />mains; and <br /> <br /> WHEREAS, the transfer of said property is to be <br />effective July 1, 1988; and <br /> <br /> WHEREAS, at the time of said transfer Hampton Roads <br />Sanitation District shall assume responsibility for treatment <br />and disposal of sewage in that portion of the City presently <br />being served by the Portsmouth Public utilities Department~ <br />and <br /> <br /> WHEREAS, the procedures set forth by the General <br />Assembly of Virginia for adding additional territory to <br />Hampton Roads Sanitation District require that a petition <br />requesting approval of such action be filed with the local <br />Circuit Court. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia, that the City Manager be, and <br />he hereby is, authorized to enter into an agreement with <br />Hampton Roads Sanitation District for the sale of certain <br />City sanitary sewage facilities. <br /> <br /> BE IT FURTHER RESOLVED that the City Attorney be, and he <br />hereby is, authorized to institute certain legal proceedings <br />in the Circuit Court of the City of Portsmouth to incorporate <br />that portion of the City presently being served by the <br />Portsmouth Public Utilities Department into Hampton Roads <br />Sanitation District. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held September 10, 1985. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
