65 A RESOLHTION GRANTING A USE PERMIT TO JOHNNY OWENS AND RICHARD Do KNAUFT FOR THE CONVERSION OF AN EXISTING SINGLE-FAMILY DWELLING TO A DUPLEX RESIDENCE AT 626 BROAD STREET (UP-85-11). WHEREAS, Johnny Owens and Richard D. Knauft, has made application pursuant to Section 40-102 (B) for a use permit to convert an existing single-family residence Go a duplex residence at 626 Broad Street which is located in the Port Norfolk Historic District; WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of a use permit with conditions for the conversion of an existing single-family dwelling to a duplex residential structure. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. Johnny Owens and Richard D. Knauft are hereby granted a use permit pursuant to Section 40-102 (B) to convert an existing single-family residence to a duplex residential structure at 626 Broad Street, such conversion to be in compliance with the regulations applicable to the Port Norfolk Historical Residential Sub-District as provided for in the Zoning Chapter of the Code of the City of Portsmouth, Virginia, 1973, as amended, such approval being granted subject to the following terms and conditions: (a) The applicant shall comply with all applicable codes, ordinances, policies, and regulations of the City of Portsmouth, Virginia, and shall obtain all necessary licenses and permits.
