A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO S40-55 OF THE CODE OP THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT BEING AN 8 UNIT CONDOMINIUM TO BE CONSTRUCTED AT 321-~35 GREEN STREET AND DESIGNATED AS GHP-84-20. WHEREAS, John S. Joannou, by Gerald F. Martin, AIA, has made application pursuant to §40-55 of the Code of the City of Portsmouth, Virginia, 1973, for the granting and approval of a group housing project consisting of 8 condominium units on property designated as 321-335 Green Street; and WHEREAS, the application has been determined by the Planning Commission to have met %he requirements of §40-55 of the Code of the City of Portsmouth, Virginia, 1973; and WHEREAS, the Planning Commission has reviewed such application and site plans submitted therewith and has recommended conditional approval of said application; and ~EREAS, the developer has been informed that approval of a group housing project pursuant to ~40-55 grants only an exemption from certain requirements for residences as stated in said section, and does not constitute a waiver of any other requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or any other applicable local, state or federal lam- or regulation; and WHEREAS, the developer is aware %hat building permits or any other required permit will be issued only upon compliance with the ordinances, laws or regulations applicable thereto. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the certain group housinq project consisting of 8 condominium units to be constructed on a parcel of land consisting of 20,767 square feet at 321- 335 Green Street, and designated as GHP-84-20, and more specifically described in correspondence from Gerald F. Martin, AIA, dated October 9, 1984, and shown on glans filed with the appropriate officials of the City of Portsmouth, Virginia, such being made a part hereof, is hereby granted approval subject to the following terms and conditions: 1. A standard site improvement plan must be submitted for approval to the Engineering & Technical Services Department showing the appropriate easements and existing utilities. 2. The permanent easement for ingress and egress as shown on the plot entitled "Subdivision of Parcel 1 Northside Redevelopment Project - Part 1 - Va. R-39", prepared for the Portsmouth Redevelopment & Housing Authority by R. Kenneth Weeks, dated June 7, 1977, shall remain open ~or ingress and egress at all times.
