The following parcel of property located at <br /> the southern tip of the above described <br /> property shall be excluded from this <br /> ordinance: A .90 acre parcel of~land now or <br /> formerly belonging to Ruth Lee copeland, <br /> generally described as having a distance of <br /> 95.67' on the north, a distance of 73.93' <br /> along the high water line on the east, a <br /> distance of 28.59' along the high water line <br /> on the south, and a distance of 64.43' on the <br /> west. <br /> 3. zoning ordinance Amendment Z-85-22 is conditioned <br />upon the following as proffered by .the petitioner: <br /> (a) The property shall be developed pursuant <br />to the group housing process prescribed in Section 40-55 of <br />the code of the City of Portsmouth, Virginia. <br /> (b) The property shall be developed as <br /> luxury condominiums at a density not exceeding twelve (12) <br /> dwelling units per acre. <br /> (c) To ensure that this property is <br /> sensitively developed the environmental and land use controls <br /> provided for herein are mandatory: <br /> (i) ARCHITECTURE - Applicant offers <br /> to allow review and prior approval by the Portsmouth Planning <br /> Director to ensure that final design adheres to the proposed <br /> architectural style, and that quality is of an acceptable <br /> level. <br /> (ii) LANDSCAPING - It is the <br /> applicant'S intention to heavily landscape the project. A <br /> full landscape buffer, including berms if needed, will be <br /> installed between all contiguous residential property. If it <br /> is believed that fencing or combination of fencing and <br /> landscaping is more appropriate, applicant agrees to comply <br /> with any reasonable decision by the Planning Department. In <br /> addition, the balance of the project will be landscaped in a <br /> manner that will create an attractive pleasing atmosphere. <br /> Applicant offers to allow review and prior approval of final <br /> landscaping plan by the Portsmouth City Planning Director. <br /> (iii) ON-SITE PARKING AND TRAFFIC <br /> Applicant offers to allow Portsmouth Planning Director review <br /> and approval of the site plan in order to ensure proper <br /> control and movement of traffic on the site. <br /> <br /> <br />
