AN ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, BY AMENDING SECTIONS <br />23-224, 23-267, 23-290, AND 23-293 THEREOF, PERTAINING TO <br />MOTOR VEHICLES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virg~nla: <br /> <br /> 1. That Section 23-224 of the Code of the City of Ports- <br />mouth, Virginia, 1973, be amended to read as follows: <br /> <br />Section 23-224. Procedure when vehicle found illegally parked. <br /> <br /> (a) Except where otherwise provided, it shall be the duty <br />of each police officer of the city to give to the person operat- <br />ing a motor vehicle illegally parked, a notice, or to attach <br />to the vehicle found so parked, a notice to the owner that such <br />vehicle has been illegally parked and instructing him to report <br />to the Portsmouth Police Department Headquarters. Each person <br />so notified may within seventy-two (72) hours from the time <br />when such notice was given or attached to the vehicle, pay <br />the sum of five dollars ($5.00) for each hour or fraction thereof, <br />during which time such vehicle was illegally parked. If the <br />owner of such vehicle fails to make such payment within <br />seventy-two (72) hours of the time such notice was attached <br />to such vehicle, then an additional penalty of five dollars <br />($5.00) shall be charged for such additional notice. <br />All such monies due shall be paid to the Chief of Police <br />or his designee, who shall be accountable therefor. <br /> <br /> The failure of the owner of such vehicle to pay the <br />penalty for the violation and the five dollars ($5.00) for <br />the additional notice within eight (8) days from the date of <br />violation shall render such owner subject to the penalties <br />provided in Section 23-1.1. <br /> <br /> (b) The contest by any person of any parking citation <br />shall be certified in writing, on an appropriate form to the <br />appropriate district court, by the Chief of Police or his <br />designee. <br /> <br /> (c) The Chief of Police or his designee shall cause <br />complaints, summons or warrants to be issued for delinquent <br />parking citations. However, before any summons shall issue <br />for the prosecution of a violation of an ordinance regulating <br />parking, the violator shall have been first notified by mail <br />at his last known address or at the address shown for such <br />violator on the records of the Division of Motor Vehicles, <br />that he may pay the fine, provided by law for such violation, <br />within five (5) days of receipt of such notice, and the authorized <br />person issuing such summons shall be notified that the <br /> <br /> <br />
