1985-72 <br /> <br />AN ORDINANCE TO AMEND THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, ~973, AS AMENDED, BY AMENDING <br />SECTIONS 14-3 AND 14-9 (a) THEREOF, PERTAINING TO <br />GARBAGE AND REFUSE. <br /> <br /> BE IT ORDAINED by the Council of the City <br />of Portsmouth, virginia: <br /> <br /> 1. That Section 14-3 and 14-9 (a) of <br />Chapter 14 of the Code of the City of portsmouth, <br />Virginia, be amended and reordained to read as <br />follows: <br /> <br />Section 14-3. <br /> <br /> Storage of garbage, refuse on <br /> premises. <br /> <br /> It shall be unlawful for garbage to be <br />placed, deposited or allowed to remain on any <br />premises within the City unless same is placed or <br />kept in a rigid, tapered, galvanized steel or <br />plastic receptacle of not less than ten (10) nor <br />more than thirty-two (32) gallons capacity and no <br />more than seventy (70) pounds total weight which <br />receptacle is covered by a tight-fitting cover of <br />galvanized steel or substantial plastic, <br />respectively, and which receptacle has two (2) <br />secure handles for lifting and emptying. The cover <br />on said receptacle shall be kept on same at all <br />times, except when the receptacle is being filled <br />or emptied. Plastic or polyethylene bags shall be <br />used only as liners in said receptacles and it <br />shall be unlawful to use same as the scle means of <br />storage of garbage or refuse on any premises within <br /> <br />the City. <br /> <br />Section 14-9 (a). Litter Receptacles. <br /> (a) As used in this section, a litter <br />receptacle shall mean those containers acceptable <br />to the Building official and which may be <br />standardized as to size, shape, capacity, and color <br />and which shall bear the State anti-litter symbol. <br />The term "litter" as used in this section shall <br />mean paper, waste materials, bottles, and cans, but <br />shall not include garbage, refuse, trash or bulk <br />refuse as defined in this chapter. Large <br />containers known as "dumpsters" may be used as <br />receptacles for the deposit of litter if said use <br />is approved by the Building official. <br /> <br /> <br />
