AN ORDINANCE TO AMEND SECTIONS 14-2 AND 14-6 PERTAINING TO DISPOSAL OF REFUSE AND GARBAGE AND TO REPEAL SECTIONS 14-4 AND 14-5 OF THE CODE OF THE CITY OF PORTSMOUTH, 1973, PERTAINING TO D~POSITING OF INCINERABLE REFUSE AND CHARGES FOR CITY INCINERATOR OR LANDFILL. WHEREAS, the City has entered into a contract with the Southeastern Public Service Authority of Virginia for operation of a regional landfill; and WHEREAS, pursuant to the terms of said agreement the City is obligated to deliver garbage and refuse to the Southeastern Public Service Authority of Virginia; WHEREAS, as a result of said agreement the City will no longer operate the incinerator or landfill for the collection of garbage and refuse. NOW, THEREFORE, BE IT ORDAINED by the Concil of the City of Portsmouth, Virginia: 1. That Section 14-2 of the Code of the City of Portsmouth be amended to read as follows: Section 14-2. Dumping of refuse prohibited. It shall be unlawful to dump or dispose of any refuse in any place in the City except in a licensed private landfill or at a site designated for such purpose and operated by the Southeastern Public Service Authority of Virginia. 2. That Sections 14-4 and 14-5 of the Code of the City of Portsmouth, Virginia, pertaining to depositing of inclnerable refuse and charges for handling refuse at the City incinerator or landfill be, and the same hereby are, repealed. 3. That Section 14-6 of the Code of the City of Portsmouth be amended to read as follows: Section 14-6. Dumping of refuse generated outside of the City. It shall be unlawful for any person to deposit or dump any refuse generated outside of the corporate limits of the City at any place within the corporate limits of the City except such site as may be designated for such purpose and operated by the Southeastern Public Service Authority of Virginia.
