2. That Section 23-213 of the Code of the City of Portsmouth, Virginia, 1973, be amended by adding thereto subsection (c) to read as follows: Section 23-213. Stopping in emergency areas. (c) The provisions of this section shall not apply to any vehicle owned or controlled by the Commonwealth of Virginia, Department of Highways and Transportation, or any unit of local government, while actually engaged ~n the construction, reconstruction or maintenance of highways. 3. That Sections 23-116.1, 23-141.1, and 23-381.2 ot the Code of the City of Portsmouth, Virginia, 1973, be enacted to read as follows: Section 23-116.1. Vehicles to be driven on right side of roadways; exceptions. Except as otherwise permitted or required by legally posted signs or other traffic control devices, and except where overtaking and passing on the right is permitted under Section 23-124, upon all roadways all vehicles shall be driven in the right-hand lane then available and clear o~ other traffic, or as close as practicable to the right-hand curb or edge of the roadway, except when overtaking and passing another vehicle proceeding in the same direction or when preparing the make a left turn. A violation of this section shall not be construed as negligence per se, or contributory negligence in any civil action. Section 23-141.1. Right of way at uncontrolled T section. Notwithstanding the provisions of Section 23-141, when vehicles arrive at approximately the same time at T intersection not controlled by any traffic control device, the driver of the vehicle on the highway or street that intersects but does no~ cross the other highway or street shall yield the right-of-way to any vehicle traveling on the other highway. Section 23-381.2. Modification of front-end suspension by use of lift. No motor vehicle whose front-end suspension been modified by the use of lift blocks shall be operated upon any street or highway in the City. has 4. That this ordinance shall take effect on July 1, 1985.
