AN ORDINANCE TO A34END THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, BY MENDING SECTIONS 23-4, <br />23-66(b)(5), 23-110, 23-117, 23-124(a), 23-141 (c), <br />23-147(a), 23-213, 23-214, 23-229, 23-365, AND 23-389 <br />THEREOF, AND BY ENACTING SECTIONS 23-116.1, 23-141.1, <br />AND 23-381.2, PERTAINING TO MOTOR VEHICLES AND TRAFFIC. <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That Sections 23-4, 23-66(b)(5), 23-110, <br />23-117, 23-124(a), 23-141 (c), 23-147(a), 23-214, <br />23-229, 23-365, and 23-389 of the Code of the City of <br />Portsmouth, Virginia be amended to read as follows: <br /> <br />Section 23-4. Emergency vehicles granted certain <br /> privileges. <br /> <br /> (a) The driver of (1) any law enforcement vehicle <br />operated by or under the direction of a federal, state, <br />or local law enforcement officer in the chase or <br />apprehension of violators of the law or persons charged <br />with or suspected of any such violation, or in response <br />to an emergency call, (2) any regional detention center <br />vehicle operated by or under the direction of a <br />correctional officer responding to an emergency call or <br />operating in an emergency situation, (3) any vehicle <br />used for the purpose of fighting fire, including <br />publicly owned state forest warden vehicles not to <br />exceed two hundred (200) in number when traveling in <br />response to a fire alarm or emergency call, or (4) any <br />ambulance or rescue or life-saving vehicle designed or <br />utilized for the principal purposes of supplying <br />resuscitation or emergency relief where human life is <br />endangered when such vehicle is being used in the <br />performance of public service, and when such vehicle is <br />operated under emergency conditions, may, without <br />subjecting himself to criminal prosecution: <br /> (1) Proceed past red signal, light, stop sign <br /> or device indicating moving traffic shall stop if the <br /> speed and movement of the vehicle is reduced and <br /> controlled so that it can pass a signal, light or device <br /> with due regard to the safety of persons and property. <br /> (2) Park or stand notwithstanding the <br /> provisions of this chapter. <br /> <br /> (3) Disregard regulations governing a <br /> direction of movement of vehicles turning in specified <br /> directions so long as the operator does not endanger <br /> life or property. <br /> <br /> <br />
