No bidder who is permitted to withdraw a bid pursuant <br />to this section shall, for compensation, supply any material <br />or labor to or perform any subcontract or other work <br />agreement for the person or firm to whom the contract is <br />awarded or otherwise benefit, directly or indirectly, from <br />the performance of the pro3ect for which the withdrawn bid <br />was submitted. <br /> If the purchasing agent denies the withdrawal of a bid <br /> under the provisions of this section, he shall notify the <br /> bidder in writing stating the reasons for his decision and <br /> award the contract to such bidder at the bid price, provided <br /> such bidder ts a responsible and responsive bidder. <br /> Procedures for the withdrawal of bids for other than <br /> construction contracts shall be the same as provided by this <br /> section for construction contracts when deemed applicable. <br /> 2. That Section 11-123 of the code of the City of <br /> Portsmouth be amended to read as follows: <br /> Section 11-123. Contract modification. <br /> A ccntract may include provision for modification of <br /> the contract during performance, but no fixed price contract <br /> may be increased by more than twenty five (25) percent of <br /> the amount of the contract or Ten Thousand Dollars <br /> ($10,000.00), whichever is greater, without advance approval <br /> of the governing body. In no event may the amount of any <br /> contract, without adequate consideration, be increased for <br /> any purpose, including, but not limited to, relief of an <br /> offeror from the consequences of an e~ror in his bid or <br /> offer. <br /> 3. That Section 11-128 of the code of the City of <br /> Portsmouth be amended to read as follows: <br /> <br /> Section 11-128. Contracting for professional services by <br /> competitive negotiation. <br /> <br /> Professional services shall be procured by <br /> competitive negotiation when the cost of the professional <br /> services expected to exceed Twenty Thousand Dollars <br /> ($20,000.00). The purchasing agent and representative of <br /> the using agency shall engage in individual discussions with <br /> all offerors deemed fully qualified, responsikle and <br /> suitable on the basis of initial responses with emphasis on <br /> professional competence, to provide the required services. <br /> Competitive and formal interviews shall be permissible. <br /> such offerors shall be encouraged to elaborate on their <br /> qualifications and performance data or staff expertise <br /> pertinent to the proposed project as well as alternative <br /> concepts. At the discussion stage, nonbinding estimates of <br /> total project costs, including where appropriate, design, <br /> <br /> <br />
