A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH~ <br />VIRGINIA, 1973, AS AMENDED, SAID PROJECT BEING A TEN UNIT <br />APARTMENT BUILDING LOCATED AT 356 BROAD STREET AND DESIGNATED <br />AS GHP-84-8. <br /> <br /> WHEREAS, Robert W. McCarty, has made application pursuant <br />to S40-55 of the Code of the City of Portsmouth, Virginia, 1973, <br />as amended, for the granting and approval of a group housing <br />project consisting of a ten (10) unit apartment building at <br />356 Broad Street; and <br /> <br /> WHEREAS, the appl±cation has been determined by the Plan- <br />ning Co~mission to have met the requirements of §40-55 of the <br />Code of the City of Portsmouth, Virginia, 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such appli- <br />cation and site plans s~bm±tted therewith and has recommended <br />approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval <br />of the housing project pursuant to ~40-55 grants only an exempt- <br />ion from certain requirements for residences as stated in said <br />section and does not constitute a waiver of any other require- <br />ment erabodied in the subdivision ordinance, zoning ordinance, <br />Code of the C±ty of Portsmouth, Virginia, or any other appli- <br />cable local, state, or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws, or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the certain group housing project <br />consisting of a ten fl0) unit apartment building to be constructed <br />at 356 Broad Street and designated as GHP-84-8 and more specifically <br />described in correspondence from Kirk Berkeley, Architect, as <br />shown on plans prepared by said architect, and filed with the <br />appropriate officials of the City of Portsmouth, Virginia, and <br />made a part herecf, is hereby granted approval subject to the <br />following terms and conditions: <br /> <br /> (al Design modifications stipulated by the Conuuission of <br />Architectural Review be incorporated in the final plans. <br /> <br /> (b~ Standard site improvement plan be submitted to the <br />Department of Engineering and include a picket fence enclosure <br />around trash receptacles. <br /> <br /> <br />
