A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH~ VIRGINIA, 1973, AS AMENDED, SAID PROJECT BEING A TEN UNIT APARTMENT BUILDING LOCATED AT 356 BROAD STREET AND DESIGNATED AS GHP-84-8. WHEREAS, Robert W. McCarty, has made application pursuant to S40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amended, for the granting and approval of a group housing project consisting of a ten (10) unit apartment building at 356 Broad Street; and WHEREAS, the appl±cation has been determined by the Plan- ning Co~mission to have met the requirements of §40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amended; and WHEREAS, the Planning Commission has reviewed such appli- cation and site plans s~bm±tted therewith and has recommended approval of said application; and WHEREAS, the developer has been informed that approval of the housing project pursuant to ~40-55 grants only an exempt- ion from certain requirements for residences as stated in said section and does not constitute a waiver of any other require- ment erabodied in the subdivision ordinance, zoning ordinance, Code of the C±ty of Portsmouth, Virginia, or any other appli- cable local, state, or federal law or regulation; and WHEREAS, the developer is aware that building permits or any other required permit will be issued only upon compliance with the ordinances, laws, or regulations applicable thereto. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the certain group housing project consisting of a ten fl0) unit apartment building to be constructed at 356 Broad Street and designated as GHP-84-8 and more specifically described in correspondence from Kirk Berkeley, Architect, as shown on plans prepared by said architect, and filed with the appropriate officials of the City of Portsmouth, Virginia, and made a part herecf, is hereby granted approval subject to the following terms and conditions: (al Design modifications stipulated by the Conuuission of Architectural Review be incorporated in the final plans. (b~ Standard site improvement plan be submitted to the Department of Engineering and include a picket fence enclosure around trash receptacles.
