A RESOLUTION GRANTING A USE PE~mIIT TO THE SOUTHEASTERN <br />PUBLIC SERVICE AUTHOR1T~ (SPSA).TO CONSTRUCT AND OPERATE <br />A SOLID WASTE TRANSFER STATION ON PROPERTY LOCATED NORTHEAST <br />OF FREDERICK BOULEVARD AND SOUTHEAST OF INTERSTATE 264. <br /> <br /> WHEREAS, the Southeastern Public Service Authority <br />has made application pursuant to ~40-69 (b) of the Code <br />of the City of Portsmouth, Virginia, as amended, for the <br />granting of a ~se permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Corm~!ssion has recommended the <br />granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not affecf the health and safety of persons <br />residing or working in the neighborhood of the proposed use; <br /> <br />injurious <br />and <br /> <br />(bl Will not be detrimental to <br />to the property or improvements <br /> <br />the public use or <br />in the neighborhood; <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. The Southeastern Public Service Authority (SPSA) is <br />hereby granted a use oermit pursuant to §40-69 (b) of the Code <br />of the City of Portsmouth, Virginia, to operate a solid waste <br />transfer facility at a site located north of Frederick Boulevard <br />and southeast of Interstate 264 consisting of Tax Plate 165, <br />Parcels 2, 3, and 4, and containing approximately 6.35 acres <br />of land bordered by the Interstate, Beltline Railroad, and <br />Frederick Boulevard (~P-84-8). <br /> <br /> 3. The following conditions are prescribed for this <br />use permit: <br /> <br /> (a) No final disposal or storage of waste will be <br />permitted. <br /> <br /> (bi Dense evergreen screening be provided along <br />north and east property lines to provide a visual and noise <br />buffer. The complete landscape plan must be submitted along <br /> <br /> <br />
