60 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO RUSS RAND ASSOCIATES <br />FOR THE INCIDENTAL INSTALLATION OF PRODUCTS BROUGHT ON PREMISES <br />IN THE ~IN B AUTO SALES STORE AT 4714 PORTSMOUTH BOULEVARD. <br /> <br /> WHEREAS, Russ Rand Associates, by C. Edward Russell, Jr., <br />General Partner, has made application pursuant to ~40-70 (b) <br />of the Code of the City of Portsmouth, Virginia, 1973, as <br />amended, for the granting of a use permit as hereinafter-described; <br />and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said appli- <br />cation; and <br /> <br /> W}{EREAS, the Planning Commission has recommended the grant- <br />ing of said use perm±%. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br />1. That the use for which the use pe_~mit is sought: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing or working in the neigb_borhood of the pro- <br />posed use; <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the property or improvements in the neighborhood; <br />and <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Russ Rand Associates are hereby granted a use permit <br />pursuant to ~40-70 (b) of the City Code to provide for incidental <br />installation of products brought on prenn~ises at the Twin B Auto <br />Sales Store at 4714 Portsmouth Boulevard, which is located within <br />a portion of that parcel designated as Tax Map 435, Parcel 1. <br /> <br /> 3. This use permit is approved subject to the following <br />conditions: <br /> <br /> Ia) No more than forty percent (40%) of the structure <br />may be nsed for parts installation. <br /> <br /> (b) Use is limited to parts installation and auto <br />repair work is not permitted. <br /> <br /> <br />
