51 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE AN EASE- <br />MENT ALONG THE EAST SIDE OF CHAUTAUQUA AVENUE; AND ACCOMPANY- <br />ING CONTRACTUAL AGREEMENT. <br /> <br /> WHEREAS, by deed of easement dated January 22, 1975, re- <br />corded in the Clerk's Office of the Circuit Court of the City <br />of Portsmouth, Virginia in Deed Book 658, page 795, and by <br />contractual agreement recorded in Deed Book 658, page 798, <br />Foley's Imports, Inc., granted a certain easement along the <br />east side of Chautauqua Avenue for the purpose of planting <br />and maintaining shrubs, bushes, trees and other green growing <br />plants; and <br /> <br /> WHEREAS, the purpose of such easement <br />agreement was to screen certain industrial <br />the adjacent residential neighborhood; and <br /> <br />and contractual <br />activities from <br /> <br /> WHEREAS, said industrial activities have been discontinued <br />and the property is to be conveyed to Doughtie's Barbecue, Inc. <br />for the expansion of office and plant facilities; and <br /> <br /> WHEREAS, the proposed site plan for the development has <br />been reviewed by the City and by the Port Norfolk Civic League <br />and it has been determined that the easement is no longer re- <br />quired. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he hereby <br />is, authorized to sign a deed to release the hereinabove-described <br />easement and contractual agreement over the following property, <br />to-wit: <br /> <br /> Ail that certain piece or parcel of property <br />located in the City of Portsmouth, Virginia, bounded <br />and described as follow-s: <br /> <br /> BEGINNING at a point on the east side of Chau- <br />tauqua Avenue 160' north from the northeast inter- <br />section of Chautauqua Avenue and Adriatic (formerly <br />Arlington) Street, and from there running north 4° <br />58' west along Chautauqua Avenue 349.65' to a point; <br />thence turning and running north 85~ 02' east 7' to <br />a point; thence turning and running south 4° 58' <br />east 349.65' to a point; thence turning and running <br />south 85° 02' west 7' to the Point of Beginning. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia <br />at a meeting held June 12, 1984. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
