126 A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO ~40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT BEING KNOWN AS "CAMBRIDGE COURT" AND DESIGNATED AS GHP-84-15. WHEREAS, Benjamin J. Levy, General Partner of Peachtree Associates, has made application pursuant to ~40-55 of the Code of the City of Portsmouth, Virginia, 1973, for the grant- lng and approval of a group housing project consisting of ninety-two (92) condominium units on 6.4 acres located in the northwest corner of Towne Point and Twin Pines Roads in- tersection; and WHEREAS, the application has been determined by the Planning Commission to have met the requirements of S40-55 of the Code of the City of Portsmouth, Virginia, 1973; and WHEREAS, the Planning Commission has reviewed such appli- cation and site plans submitted therewith and has recommended conditional approval of said application; and WHEREAS, the developer has been informed that approval of a group housing project pursuant to ~40-55 grants only an exempt- ion from certain requirements for residences as stated in said section and does not constitute a waiver of any other require- ment embodied in the subdivision ordinance, zoning ordinance, Co~e of the City of Portsmouth, Virginia, or any other appli- cable local, state or federal law or regulation; and o~ k~ lo~ Ro~ Jo~ J. th~ sm je WI~EREAS, the developer is aware that building permits or - other required permit will be issued only upon compliance .h the ordinances, laws or regulations applicable thereto.
