123 A RESOLUTION GRANTING A USE PERMIT TO LIZZIE AND CLAYTON JACKSON TO OPERATE AN AUTOMOTIVE SERVICE STATION AT 2921 PORTSMOUTH BOULEVARD. WHEREAS, Lizzie and Clayton Jackson have made application pursuant to §40-70 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter described; and .- WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said appli- cation; and WHEREAS, the Planning Commission has made a recommendation regarding the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter- described is sought: {a) Will not adversely affect the health and safety residing or working in the neighborhood of the pro- of persons posed use; (b) Will not be detrimental to the public use or injurious to the property or improvements of the neighborhood; and (c) Will be in accordance with the.purposes of the Zoning Chapter of the City Code. 2. Lizzie and Clayton Jackson are hereby granted a use permit pursuant to ~40-70 (b) of the Code of the City of Ports- mouth, Virginia, 1973, to operate an automotive service station as defined in §40-31 of said Code at 2921 Portsmouth Boulevard, such property being more particularly described as follows: UP-84-15 BEGINNING at the southeast corner of Ports- mouth Boulevard and Royal Street; thence south along the east side of Royal Street 110', more or less; thence east 120'; thence north 110', more or less to the south right-of-way of Portsmouth Boulevard; thence west along said right-of-way to Royal Street, the Point of Origin.
