121 <br /> <br />A RESOLUTION INDEPINIFYING TF2E COMMONWEALT~ OF VIRGINIA FOR <br />LOSS OCCASIONED BY WORK ON OR UPON ~ HIG~AY SYSTEM OF <br />VIRGINIA. <br /> <br /> ~q~EREAS, it becomes necessary from time to time for the <br />City of Portsmouth to obtain permits from the Virginia <br />Department Of Highways and Transportation to install, con- <br />struct, reconstruct, maintain, and operate-certain public <br />works along, across, over and upon the highway system of <br />Virginia; and <br /> <br /> WRE. REA-S, expense, damage, er injury may be sustained by <br />the Commonwealth of Virginia growing out of' thegranting to <br />the City of Portsmouth by the Virginia Department of Highways <br />and Transportation of said permit for the work; and <br /> <br /> W~EREAS., one of the conditions of such permit or permits <br />is that the City of Portsmouth shall indemnify the Co~onweatth <br />of Virginia against all damages and injuries to the highways <br />and bridges and to persons or property lawfully upon such <br />highways. <br /> <br /> NOW, THEP~EFORE, BE IT RESOLVED by the ~ouncil of the <br />City of Portsmouth, Virginia, that the City Of Portsmouth <br />shall in all respects complywith all of the conditions of <br />the permit or permits that have been, or will be, granted <br />to the City of Portsmouth by the Virginia Department of <br />Eighways and T~anspertation, and ~sha~l indemnify and save <br />harmless the Commonwealth of Virginia against and from all <br />loss, cost, expense, damage or i~jury to highways andbridges <br />and to persons and property lawful on such highways growing <br />out of the granting of such permit or permits to the said <br />City of Portsmouth. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held November 13, 198~. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
