112 <br /> <br />A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PRO- <br />PERTY BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT <br />DOMAIN PROCEEDINGS, PURSUANT TO CHAPTER 471 OF THE ACTS OF <br />ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR <br />THE CONSTRUCTION, ALTERATION, AND MAINTENANCE OF THE MID- <br />CITY DRAINAGE PROJECT. <br /> <br /> WHEREASr the City of Portsmouth has found it necessary <br />to acquire the interest hereinafter-described in and to the <br />property hereinafter-described, situate in the City of Ports- <br />mouth, Virginia, for the purpose of constructing, altering, <br />and maintaining the Mid-City drainage project; and <br /> <br /> WHEREAS, the City of Portsmouth has not been able to <br />purchase the property necessary to the~project because the <br />present owner of the property cannot be located; and <br /> <br /> WHEREAS, advancement of the work and use <br />will be delayed unreasonably if said property <br />available as soon as possible. <br /> <br />of said project <br />is not made <br /> <br />City <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council <br />of Portsmouth, Virginia: <br /> <br />of the <br /> <br /> That the City Attorney be hereby directed to institute <br />eminent domain proceedings against the owner of the following <br />described property for the purpose of acquiring fee simple <br />title therein, together with any and all easements of access, <br />light, or air incident to the lands of the landowner abutting <br />upon said property, in accordance with and pursuant to ~2.06, <br />2.07 and 2.08 of the Charter o~ the City of Portsmouth (Chapter <br />471 of the Acts of Assembly of 1970, as amended), and to deposit <br />to the credit of the Clerk of the Circuit Court of the City of <br />Portsmouth as provided by law the sum hereinafter specified <br />to compensate the owner of land described as follows, to-wit: <br /> <br /> BEING the eastern one half of Lot 15, Block <br />32 on the plat of "Virginia Realty and Investment <br />Corporation", recorded in the Clerk's Office of <br />the Circuit Court of the City of Chesapeake, Vir- <br />ginia, in Map Book 7, Pages 98, 99 and 100. Said <br />property being more particularly described as <br />follows: <br /> <br /> BEGINNING at the southwestern right-of-way <br />intersection of Columbia Street and Landcaster <br />Street; thence along the southern right-of-way of <br />Columbia Street south 88°19'24" west, 168.47' to <br />a point; thence along a curve ko the right having <br /> <br /> <br />
