llO A RESOLUTION AMENDING THE USE PERMIT G¥~NTED TO ~R. AND MRS. THOMAS B. VELASCO TO OPERATE A PRIVATE RESIDENCE AND HOME FOR THE ELDERLY AT 3736 TURNPIKE ROAD. WHEREAS, the Council of the City of Portsmouth, Virginia, granted a use permit to Mr. and Mrs. Thomas B. Velasco to operate a private residence and home for the elderly near the intersection of Utah Street and Kigman Avenue on January 8, 1980, which permitted no more tha~ nine (9) elderly female guests in the convalescent and nursing home; and WHEREAS, the Council of the City of Portsmouth, Virginia~ amended said use permit on October 25, 1983 to permit resi- dency by not more than twelve (12) elderly persons; and WHEREAS, ~r. & Mrs. Velasco has ~ade application pursuant to ~40-75 (b) of the Code of the City of Portsmouth, Virginia, 1973, to amend said use permit to add twenty (20) additional elderly persons; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter- described is sought: of persons posed use; (a) Will not adversely affect the health and safety residing and working in the neighborhood of the pro- (b) Will not be detrimental to the public use or injurious to property and improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. That Mr. & Mrs. Thomas B. Velasco is hereby granted a use permit pursuant to ~49-75 (b) of the Code Of the City of Portsmouth, Virginia, 1973, to operate a private residence and home for the elderly on property hereinafter-described:
