10 A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH' CO~LMUNIT¥ SERVICES BOAR~ TO OPERATE A GROUP RESIDENCE FOR ALCOHOL RE- HABILITATION AND TREATMENT FACILITY AT 1000 GREEN STR~RT. WHEREAS, James M. Nixon, Executive Director for the Effing~am Street Branch YMCA, has made application pu3csuant to §40~79 (b) of the Code of the City of Portsmouth, Virginia, as amended, for the granting of a use permit as hereinafter- described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection With said application; and WHEREAS, the Planning Commission has recommende~ the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is so~ght~ (a) Will not affect the health and safet~ of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the pub!louse or injurious to the property or improvements in the neighborhood; and (c) Will be in accord with the purposes ~f the Zoning Chapter~f the City Code. 2. The Portsmouth Community Services Board is hereby granted a use permit pursuant to ~40-79 (b) of the Code of the City of Portsmouth, Virginia to operate a group ~e~idence for thirty two (32) residents for alcohol rehabilitation and treatment at 1000 Green Street (UP-83-23). 3. The following conditions are prescribed fo~' this use permit: ~a) Occupancy is limited to thirty-two-residents unless Building and Fire Officials of the City of Portsmouth determine a smaller nun~ber is required. Cb) Ail fire, building and health codes must be met prior to occupancy. (c) Off-street parking must be provided to accommodate the staff of the facility.
