96 <br /> <br />A RESOLUTION GP~ANTING A USE PERMIT TO JOYCE HALL TO OPERATE <br />A FAMILY CARE HOME AT 1229 ALCINDOR ROAD. <br /> <br /> WHEREAS, Joyce Hall has made application pursuant to <br />~40-75 (b) of the Code of the City of Portsmouth, Virginia, <br />1973, for the granting of a use permit to operate a child <br />care center; and - ~ ' <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said appli- <br />cation; and <br /> <br /> WHEREAS~ the Planning Co~mission has recommended the grant- <br />ing of a use permit for the operation of a family care home. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the .City <br />of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is recommended: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing or working in the neighborhood of the proppsed <br />use; <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the property or improvements in the neighborhood; <br />and <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Joyce Hall is hereby granted a use permit pursuant <br />to ~40-75 (b) of the City Code to operate a family care home <br />at the property described as Tax Plate 678, Parcel 66, and <br />designated as 1229 Atcindor Road. (UP-~4--9). <br /> <br /> 3. This use permit is approved subject to the following <br />conditions: <br /> <br /> (a) Ail interior operations of this facility must <br />be conducted between the hours of 6:00 a. m. and 6:00 p. m.. <br /> <br /> (b) Ail outdoor play activities shall be conducted <br />within a fenced play area of not less than 1,500 square feet <br />and limited to the hours of 8:00 a. m. to 6:00 p. m.. <br /> <br /> <br />
