A RESOLUTION GRANTING A USE pERMIT TO JAMES K. BYNUM TO CONVERT ~-N EXISTING SINGLE FAMILY DWELLING TO A DUPLEX AT 64 LIND~ AVENUE. WHEREAS, James E. Bynum has made application pursuant tO §40-102 (10) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said appli- cation; and WHEREAS, the Planning Commission has reco~/nended the granting cf said use permit. ~ NOW, THEREFORE, BE IT RESOLVED.by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the pro- posed use; (b) injurious to and Will not be detrimental to the public use or the property or improvements in-the neighborhood; (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. James K. Bynum is hereby granted a use permit pursuant to ~40-102 gl0) of the City Code to convert an existing single family dwelling to a duplex at 64 Linden Avenue, more specifically described as Tax Map 30, Parcel 65 (UP-84-10). 3. This use permit is ~pproved subject to the following conditions: (a) The applicant shall provide the two (2) required on-site pa~king spaces as approved by the Commission of Architectural Review for Port Norfolk and Park View. (b) The applicant shall comply with all codes, ordinances, policies, and regulations that may be applicable to the conversion and use as a duplex, and shall obtain all necessary licenses and permits required for the conversion and subsequent use of the property as a duplex.
