93 <br /> <br />A RESOLUTION GRANTING A USE PE~4IT TO ROY C. FIELDS AND HENRY <br />S. STATON TO OPERATE AN AUTOMOTIVE SERVICE STATION AT 2612 <br />ELLIOTT AVENUE. <br /> <br /> WHEREAS, Roy C. Fields and Henry S. Staton have made appli- <br />cation pursuant to §40-70 (b) of the Code of the City of Ports- <br />mouth, Virginia, 1973~ for the granting of a use permit as here- <br />inafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said application; <br />and <br /> <br /> WHEREAS, the Planning Commission has made a recommendation <br />regarding the granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit hereinafter- <br />described is sought: <br /> <br />of persons <br />use; <br /> <br />(a) Will not adversely affect the health and safety <br />residing or working in the neighborhood of the proposed <br /> <br /> (b) Will not be detrimental to the public use or in- <br />jurious to the property or improvements of the neighborhood; and <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Roy C. Fields and Henry S. Staton are hereby granted <br />a use permit pursuant to ~40-70 (b) of the Code of the City of <br />Portsmouth, Virginia, 1973, ~o operate an automotive service <br />station as defined in S40-31 at 2612 Elliott Avenue, such pro- <br />perty being further described ks Tax Map 414, Parcel 10 (UP-84- <br />12). <br /> <br /> 3. This use permit is approved subject to the following <br />condition: <br /> <br /> (a) A six (6) <br />rear property line prior <br />station. <br /> <br />foot privacy <br />to operation <br /> <br />fence be erected along the <br />as an automotive service <br /> <br /> <br />
