92 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTS- <br />MOUTH, VIRGINIA, 1973, SAID PROJECT BEING A SIX UNIT APART- <br />MENT BUILDING AT 105-115 CHAF~ES AVENUE AND DESIGNATED AS <br />GHP-84-t4. <br /> <br /> WHEREAS, M. W. D. Associates, by Richard L. Dail~ <br />partner, has made application pursuant to ~40-55 of the <br />Code of the City of Portsmouth, Virginia; 1973, as amended, <br />for the granting and approval of ~ group housing pro3ect <br />consisting of a six unit apartment building at 105-115. <br />Charles Avenue; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of ~40-55 <br />of the Code of the City of Portsmouth, Virginia, 1973; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such appli- <br />cation and site plans submitted therewith and has recommended <br />approval of said application; and <br /> <br /> k~EREAS, the developer has been informed that approval <br />of a group housing project pursuant to ~40-55 grants only an <br />exemption from certain requirements for residences as stated <br />in said section and does not constitute a waiver of~any other <br />requirement embodied in the subdivision ordinance, zoning <br />ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable localt state or federal law or regulation; <br />and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws, or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by t~e Council of the City <br />of Portsmouth, Virginia, that the certain group housing project <br />consisting of a six unit apartment building at 105-115 Charles <br />Avenue and designated as GHP-84-14, and more Specifically <br />described in correspondence from M.W.D. Associates, dated <br />August 21, 1984, and plans filed with the appropriate officials <br />of the City of Portsmouth, Virginia, such being made a part <br />hereof, is hereby granted approval subject to the following <br />terms and conditions: <br /> <br /> (1) Prior to issuance of any occupancy permits, the site <br />improvement plan must be approved by the Department of Engineering <br />and Technical Services and the landscaping and privacy fence <br />must be properly.installed. <br /> <br /> <br />
