89 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTS- <br />MOUTH, VIRGINIA, 1973, SAID PROJECT BEING AN ADDITION TO <br />WATERS EDGE CONDOMINIUMS AND DESIGNATED AS GHP-84-10. <br /> <br /> WI4EREAS, the Council of the City of Portsmouth granted <br />approval fora group housing project being known as Waters <br />Edge and designated as GHP-83-6 on December 13, 1983; and <br /> <br /> WHEREAS P~ H. Boyette, Jr. & Company, Inc. has made <br />application pursuant to ~40-55 of the Code of the City of <br />Portsmouth, Virginia, 1973, for the granting and approval <br />of a group'~housing permit consisting of an addition of six <br />(6) more units~to the Waters Edge Condominiums; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of S40-55 <br />of the Code of the City of Portsmouth, Virginia, 1973; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plans submitted therewith and has re- <br />commended a conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval <br />of a group housing project pursuant to ~40-55 grants only an <br />exemption from certain requirements for residences as stated <br />in said section and does not constitute a waiver of any other <br />requirement eh%bodied in the subdivision ordinance, zoning <br />ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, state or federal laws or regulations; <br />and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws, or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT P~SOLVED by the Council of the City <br />of Portsmouth, Virginia, that the certain group housing project <br />known as an addition to Waters'Edge Condominiums consisting of <br />six (6) units on the property adjacent to the southern boundary <br />of the existing condominium project now under construction and <br />designated as GHP-84-10, more specifically shown on plans Sub- <br />mitted by the applicant and filed with the appropriate officials <br />of the City of Portsmouth, Virginia, as outlined in correspondence <br />from P. H. Boyette, Jr. & Company, Inc. dated June 6, 1984, which <br />plans are made a part hereof, is hereby granted approval subject <br />to the following terms and conditions: <br /> <br /> <br />
