AN ORDINANCE TO ~MEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTIONS 35-2 (b) AND 35-3 (c) <br />PERTAINING TO PENALTY FOR NONPAYMENT OF REAL ESTATE AND <br />PERSONAL PROPERTY TAXES, RESPECTIVELY. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virgznia: <br /> <br /> 1. That Section 35-2 (b) of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended and reordained to <br />read as follows: <br /> <br />Section 35-2. <br /> <br />Date real estate tax payable; penalty for <br />nonpayment; deferment of payment; payment of <br />administrative costs. <br /> <br /> (b) In the event any installment of taxes on real <br />estate is not paid on or before the ~ime the same is due and <br />payable, as provided in subsection (a) of this section, <br />there shall be added thereto a penalty of ten percent (10%) <br />of the amount of such unpaid installment, or ten dollars <br />($10.00), whichever is greater, but ~aid penalty is not to <br />exceed the amount of such-unpaid installment, and such <br />installment shall bear interest at the rate of one percent <br />(1%) per month, or fraction thereof, from the first day of <br />the month following the date the same is due and payable <br />until paid. If any installment of taxes on real estate ~s <br />not paid before the property is advertised or posted as <br />delinquent, an expense charge of twenty-five cents ($0.25) <br />for each installment on each parcel assessed shall be collected. <br /> <br /> 2. That Section 35-3 <br />Portsmouth, Virginia, 1973, <br />read as follows: <br /> <br />(c) of the Code of the City of <br />be amended and reordained to <br /> <br />Section 35-3. <br /> <br />Date personal property tax payable; interest <br />for nonpayment; penalty for nonpayment; pay- <br />ment of administrative costs. <br /> <br /> (c) In the event any taxes on personal property and <br />machinery and tools are not paid on or before the time the <br />same are due and payable, there shall be added thereto a <br />penalty of ten percent (10%) of such unpaid taxes, or ten <br />dollars ($10.00), whichever is greater, but said penalty is <br />not to exceed the amount of such unpaid tax. <br /> <br /> 3. This ordinance shall take effect from the date of <br />its adoption. <br /> <br /> <br />
