DIVISION 4. CLASS III <br /> INDUSTRIAL D ISC~iARGERS <br /> <br />Secion 38-108. Permit and Information Requirements. <br /> <br /> (a) Ail Class III users and other users whose discharge <br />is deemed as significant by the Director shall obtain a Wastewater <br />Discharge Permit before connecting to or contributing to the <br />wastewater facility. All existing Class III users or others <br />so designated to have a significant.discharge shall obtain a <br />Wastewater Discharge Permit within 180 days after the effective <br />date of this Article. As processes, etc. are added or deleted, <br />new permit information shall be supplied. <br /> <br /> (b) Ail Class III dischargers shall file with the City <br />wastewater inforalation deemed necessary by the Director for <br />determination of compliance with this Article, the City's <br />NPDES permit conditions, and state and federal la%~ prior to <br />issuance of a permit. Such information shall be provided by <br />completion of a questionna±re designed and supplied by the <br />Director and by supplements thereto as may be necessary. In- <br />formation requested in the questionnaire and designated by <br />the discharger as confidential is subject to the conditions <br />of confidentiality as set out in Section 38-108(d) of this <br />Article. <br /> <br /> (c) Where a person owns, operates or occupies properties <br />designated as a Class III discharger at more than one location, <br />separate information submittals shall be made for each location <br />as may be requl~ed by the Director. <br /> <br /> (d~ The Director shall implement measures to ensure the <br />c6nfidentia!ity of information provided by a Class II~ dis- <br />charger pursuant to this Article. In no event shall the <br />Director delegate this responsibility or disclose any claimed <br />confidential information to any person without prior notice in <br />writing to the owner and without providing the o~er with the <br />opportunity to protect such confidential information, including <br />the right to seek judicial relief. Waste~ater discharge data <br />is deemed non-confidential and shall be made available to the <br />public without restriction. <br /> <br /> (e) Permits shall be issued for a specified time period, <br />not to exceed five ~5~ years. A permit may be issued for a <br />period less than a year or may be stated to expire on a <br />specific date. The user shall apply for permit reissuance <br />a minimum of 180 days prior to the expiration of the user's <br />existing permit. The terms and conditions of the permit may <br />be subject to modif±cation by the City during the term of the <br />permit as federal or state limitations or requirements are <br />modified or other just cause exists. The User shall be informed <br />of any proposed changes in his permit at least 30 days prior <br />to the effective date of change. Any changes or new conditions <br />in the permit shall include a reasonable time schedule for <br />compliance. <br /> <br />11 <br /> <br /> <br />
