DIVISION 4. CLASS III INDUSTRIAL D ISC~iARGERS Secion 38-108. Permit and Information Requirements. (a) Ail Class III users and other users whose discharge is deemed as significant by the Director shall obtain a Wastewater Discharge Permit before connecting to or contributing to the wastewater facility. All existing Class III users or others so designated to have a significant.discharge shall obtain a Wastewater Discharge Permit within 180 days after the effective date of this Article. As processes, etc. are added or deleted, new permit information shall be supplied. (b) Ail Class III dischargers shall file with the City wastewater inforalation deemed necessary by the Director for determination of compliance with this Article, the City's NPDES permit conditions, and state and federal la%~ prior to issuance of a permit. Such information shall be provided by completion of a questionna±re designed and supplied by the Director and by supplements thereto as may be necessary. In- formation requested in the questionnaire and designated by the discharger as confidential is subject to the conditions of confidentiality as set out in Section 38-108(d) of this Article. (c) Where a person owns, operates or occupies properties designated as a Class III discharger at more than one location, separate information submittals shall be made for each location as may be requl~ed by the Director. (d~ The Director shall implement measures to ensure the c6nfidentia!ity of information provided by a Class II~ dis- charger pursuant to this Article. In no event shall the Director delegate this responsibility or disclose any claimed confidential information to any person without prior notice in writing to the owner and without providing the o~er with the opportunity to protect such confidential information, including the right to seek judicial relief. Waste~ater discharge data is deemed non-confidential and shall be made available to the public without restriction. (e) Permits shall be issued for a specified time period, not to exceed five ~5~ years. A permit may be issued for a period less than a year or may be stated to expire on a specific date. The user shall apply for permit reissuance a minimum of 180 days prior to the expiration of the user's existing permit. The terms and conditions of the permit may be subject to modif±cation by the City during the term of the permit as federal or state limitations or requirements are modified or other just cause exists. The User shall be informed of any proposed changes in his permit at least 30 days prior to the effective date of change. Any changes or new conditions in the permit shall include a reasonable time schedule for compliance. 11
