"WASTEWATER TREATMENT FACILITY" shall mean the structures, <br />processes, equipment and arrangements necessary to treat and <br />dis ctiarge wastewaters. <br /> <br />"WPCF" shall mean the Water Pollution Control Federation. <br /> <br /> (Unless the context of usage indicates otherwise, the <br />meaning~of terms in this Article not defined herein shall <br />be as defined in the "Glossary: Water and Wastewater Control <br />Engineering" prepared by Joint Editorial Board of the American <br />Public Health Association, American Society of Civil Engineers, <br />American Water Works Association, and Water Pollution Control <br />Federation. <br /> <br />Section 38-101. Notice of Violation. <br /> <br /> Any persen found in violation of this Article or any <br />requirement of a permit issued hereunder, may be served with <br />a written notice stating the nature of the violation and <br />providing a reasonable time limit for compliance. Any such <br />notice given shall be in writing to the owner or occupant, or <br />both, of the premises on or in which the violation exists, <br />and shall order the owner or occupant, or both, to bring same <br />into compliance within such reasonable time as the Director <br />shall specify in the notice. Service of the notice required <br />to be given herein shall be made by mailing the notice to the <br />last known street or post office address of the person, agent, <br />executor, administrator, trustee, guardian or occupant to <br />whom it is directed, or by delivery thereof to such person, <br />agent, executor, administrator, trustee, guardian or occupant. <br />Prgof of so mailing or delivering a notice shall be sufficient <br />evidence that the notice was served, and the date of mailing <br />or delivery as the case may be, shall be the date of service. <br />In the event the last known street or post office address of <br />the person, ~gent, executor, administrator, trustee, guardian <br />or occupant is unknown, or the no%ice so mailed is returned <br />undelivered by the Post Office Department, then service of the <br />notice shall be made by posting the notice on the land or <br />premises on which the violation exists. Proof of posting the <br />notice shall be s~fficient evidence that the notice was served <br />and the date of posting shall be the date of service. <br /> <br />Section 38-102. Penalty. <br /> <br /> (a) Any person who contlnue~ to violate the discharge <br />provisions of thi's Article beyond the time limit provided for <br />in S38-101 shall be guilty of a Class III Misdemeanor. Each <br />day's continuance of such violation shall constitute a separate <br />offense. <br /> <br /> <br />
