AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTIONS 40-121 (a) (i), (iv), <br />(vi), (vii), 40-121 (b), 40-122, 40-123, AND 40-31, AND BY <br />REPEALING SECTIONS 40-121 (a), (iii) AND (vi), PERTAINING TO <br />THE DOWNTO~ D-1 DISTRICT. <br /> <br /> BE TT ORDAINED by the Council of the City of'Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-31 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended by adding thereto the <br />following definitions to read as follows: <br /> <br />Section 40-31. Definition. <br /> <br /> BED AND BREAKFAST ESTABLISHMENT: A principal building <br />wherein a maximum of fifty percenn (5Q%) of the floor area is <br />rented by a resident owner to provide overnight accommodations <br />and breakfast for transient guests. <br /> <br /> 2. That Section 40-121 (a) (i) be amended by including <br />therein the following described uses: <br /> <br />Art studios and galleries; <br />Athletic and health clubs; <br />Clubs and other places of entertainment operated <br /> commercial enterprises and private clubs; <br />Dairy bars and ice cream manufacturer for retail <br /> on the premises only; <br />Department and variety stores; <br />Drug stores; <br />Laundry mats; <br />Marina: A small harbor or boat basin providing <br /> dockage, supplies or services for small pleasure <br /> craft; <br />Automotive service stations upon the granting of a <br /> use permit as provided in this Chapter. <br /> <br />as <br /> <br />sale <br /> <br />3. That Section 40-121 (a) (iii) be repealed. <br /> <br /> 4. That Section 40-121 (a) (iv) be amended by adding <br />thereto the following described use: <br /> <br /> Churches and places of worship, including parish houses <br />and educational buildings upon the granting of a use permit <br />as provided in this Chapter. <br /> <br /> <br />
