AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH <br />AMENDING SECTIONS 7-3, 7-4 (a) AND 21-119, PERTAINING TO <br />CF~4ETERIES. <br /> <br />BY <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 7-3 of the Code of the City of Portsmouth, <br />Virginia, 1973. be a~ended and reordained to read as follows: <br /> <br />Section 7-3. Trespassing at night. <br /> <br /> If any person, without the consent of the o~ner, proprietor <br />or custodian, shall go or enter in the nighttime, upon the <br />premises, property, driveways or walks of any cemetery, either <br />public or private, for any purpose other than to visit the <br />burial lot or grave of some member of his family, he shall be <br />guilty of a trespass and upon conviction thereof shall be <br />fined not more than one hundred dollars. <br /> <br /> 2. That Section 7-4 (.a) of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended and reordained to <br />read as follows: <br /> <br />Section 7-4. Malicious mischief° <br /> <br />(a) ~f any person shall: <br /> <br /> (1) Willfully or maliciously destroy, mutilate, <br />deface, injure or remove any tomb, monument, gravestone or <br />other structure placed within any cemetery, graveyard or <br />other place of burial or any lot belonging to any memorial <br />or monumental association within the City or any fence, <br />railing, or other work for the protection or ornament of <br />any tomb, monument, gravestone or other structure aforesaid, <br />or any cemetery lot within any-cemetery; <br /> <br /> ~2) Willfully or maliciously destroy, remove, cut, <br />break or injure ~ny treej shrub or plant within any cemetery <br />or lot of any monumental or memorial association; <br /> <br /> (~ Willfully or maliciously destroy, mutilate, <br />injure or remove and carry away any flowers, wreaths, vases or <br />other ornaments placed upon or around any grave, tomb, <br />monument or lot in any cemetery, graveyard or other place of <br />burial; <br /> <br /> <br />
