AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRG~NiA, 1973, BY AMENDING SECTION 40-48 (3) (b~ TF~REOF, <br />PERTAINING 'TO THE GENERAL REQUIREMENTS FOR PARKING LOTS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that the Code of the City of Portsmouth, Virginia, <br />1973, be amended and reordained by a~ending S40-¢8 (3) (b) <br />thereof, such amended section to read as follows: <br /> <br />(3) Construction requirements for improvements. <br /> <br /> (b) Bituminous concrete or portland cement concrete <br />shall be installed for all street improvements and widenings <br />and shall be designed and installed subject to the approval of <br />the City Engineer according to the street classification and <br />use. All parking facilities shall be paved with bituminous <br />concrete, portland cement concrete, or bituminous surface treat- <br />ment fdouble prime and seal) as approved by the City Engineer <br />in accordance with the proposed use. The City Engineer may re- <br />quire paving surfaces and/or cons%ruction techniques which mini- <br />mize surface storm water runoff in areas ~here it is d~eme~ <br />necessary. The developer may select precast interlocking blocks, <br />porous type asphault paving, detention basins, or other methods <br />approved by the City Engineer. All ~rainage calculations for <br />parking areas shall utilize, as a minimum, storm water runoff <br />co-efficients for the parking lot as if paved in its entirety <br />with non-porous bituminous concrete. In M-1 and M-2 Industrial <br />Zones, storage lots and service areas away from street frontage <br />will no~ require paving or sealing as long as same does not <br />result in dus~% dirt, sand, gravel and similar materials being <br />deposited or tracked on public streets or rights-of-way. <br /> <br /> Ail parking lots shall be designed and constructed in <br />such a manner that dust, dirt, sand, gravel and similar <br />materials will not be deposited on public streets or rights-_ <br />of-way. The owner or Occupant of any land within the City <br />in which a parking lot exists shall be responsible for <br />cleanup operations. The depositing and tracking of dust, <br />dirt, sand, gravel and similar materials from a parking lot <br />shall be unlawful and shall constitute a nuisance.. Whenever <br />it is determined that a nuisance as defined herein exists, <br />the owner or occupant of the site shall be given notice in <br />writing of the existence of the nuisance, and if same is not <br />abated within fifteen (15) days of receipt of said written <br />notice, the City may cause the nuisance to be abated and <br />bill the owner or occupant thereof for all costs incurred <br />thereby. <br /> <br /> <br />
